Proposition 218 Process: Solid Waste Rates
Proposition 218 was approved by California voters in 1996. It requires public agencies to notify property owners and rate payers of potential utility rate increases and provide a 45-day period to protest rates. The Proposition 218 process concludes with a Public Hearing where the City Clerk announces the number of rate protests received. If the protest count is 50% + 1 of the parcels, the rate increase cannot be passed along to the rate payer. If the protest count is less than 50% + 1 of the parcels, then the City Council can vote to adopt the proposed rates. The approved Proposition 218 lasts for five years. The City of Manhattan Beach is currently in year five of the five year approval (FY2020 - FY2025) and therefore must go through the Proposition 218 process in order to pass along solid waste increases to the rate payer for the next five years (FY2026 - FY2030).
